    Because Rare didn't create Donkey Kong and doesn't own anything related to him.

    Nintendo hired Rare to make a Donkey Kong game for them, just because they made the game doesn't mean they own anything about it. Nintendo obviously made sure back then that they had full control over their IPs back then and still do.
