Why?!

Why is Shrek not in the game?! Isn't he from Super Mario Bros. 3 and owned by Nintendo? Will we ever gonna see our Heroic Ogre in a new Smash Bros. game? Why does Sakurai keep making him angry when he's not in the game? Isn't he also a highly reasonable character choice?
