    It seems Inti Creates is aware of the issue and is looking into it. Hopefully it will be resolved in the next few days.

    The update and Ekoro are arriving tomorrow when the eShop updates, with an extension to the free download period for NA 3DS users due to the inconvenience. Closing this post now.
