In the 90's Marvel was going bankrupt, so they sold the film rights of many of their properties to keep themselves afloat. While overtime most of the film right have reverted back to them. In fact, last year's Fantastic Four was released only to keep the rights in Fox's hands, because their contract would expire if they didn't keep release a film every so often.
