You actually can StreetPass other people while you have a game or application open. Not original DS games though, because those disable the 3DS features. And your wireless connection needs to be turned on! Also, try doing a web search for "StreetPass relay points" for a list of local stores that automatically pass on tags from recent visitors when you bring your 3DS.
